Commission Terms
Bookings and Deposits
Submitting an enquiry does not confirm a booking. A commission is confirmed once the quote has been accepted and the required deposit has been received.
The deposit secures your place in the commission queue. The remaining balance must be paid in full before the artwork is dispatched or collected.
Copyright and Ownership
The original artwork remains the property of the artist until it is paid for in full. Copyright in commissioned artwork remains with Arty Flare, subject to the written Commission Agreement and applicable Australian law. Purchasing an original artwork does not, by itself, grant permission to reproduce, sell or commercially use images of the artwork.
Display and Promotional Rights
Arty Flare retains the right to photograph, reproduce, publish and display images of artwork created by the artist, including commissioned portraits, for portfolio, website, social media, promotional, marketing and exhibition purposes.
This display permission forms part of the commission agreement and is a condition of accepting a commission. Customers who do not agree to these terms should not proceed with a commission booking.
Reference Photographs
Customers retain any rights they hold in photographs they supply. By supplying a photograph, customers confirm that they have the necessary rights or permissions for it to be used as a reference and authorise Arty Flare to use it for creating the commissioned artwork and for the agreed promotional purposes, subject to the Commission Agreement.
Consumer Rights
Nothing in these terms excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law or other applicable laws.
